1. Purpose

These General Terms and Conditions govern the use of the CB Consulting website and the financing services provided by Christophe Bresilley Consulting ("the Service Provider").

2. Definitions

• "Client": Any natural or legal person who requests a financing service
• "Loan": The financing granted according to the signed conditions
• "Contract": The loan agreement signed and dated between the parties
• "Site": The CB Consulting website

3. Acceptance of Terms

By using this website or submitting a financing request, you automatically accept these terms. If you do not agree, please leave the site immediately.

CB Consulting reserves the right to modify these terms at any time. Changes take effect immediately. Continued use of the site constitutes acceptance of the modifications.

4. Eligibility

To use our services, you must:

• Be of legal age (at least 18 years)
• Have the legal capacity to enter into contracts
• Not be registered in negative files (FICP)
• Pass the KYC (Know Your Customer) verification
• Provide all required documents

CB Consulting reserves the right to reject any application without justification.

5. Application Process

5.1 Submission

You complete the online form. This information is treated confidentially according to our Privacy Policy.

5.2 Analysis

Processing time: 24-48 hours. CB Consulting reviews your file, performs legal checks, and assesses your eligibility.

5.3 Offer

If approved, you receive a detailed offer: amount, rate, term, fees. This offer is valid for 14 days.

5.4 Signing

You sign the contract electronically. The document creates a full legal commitment.

5.5 Disbursement

Funds disbursed 24-48h after signing. Bank transfer or crypto depending on agreement.

6. Rates and Fees

6.1 Transparency

• ✅ Zero processing fees
• ✅ All fees are listed in the offer
• ✅ No hidden fees
• ✅ APR (Annual Percentage Rate) indicated

6.2 Rate Fluctuations

Rates vary depending on: credit profile, collateral, amount, term, market conditions.

7. Repayment

7.1 Terms

• Fixed monthly payments (depending on term)
• Automatic debit from account
• No penalty for early repayment

7.2 Late Payment

• 0-5 days: Courtesy reminder
• 5-30 days: 1.5% surcharge per month
• 30+ days: Possible legal action

8. Responsibility

8.1 CB Consulting

• Responsible for the stated loan conditions
• Responsible for data protection
• NOT responsible for: Financial markets, crypto volatility, borrower's personal decisions

8.2 Client

You are responsible for:

• Accuracy of information provided
• Timely repayment
• Confidentiality of access credentials

9. Limitation of Liability

CB Consulting is not responsible for:

• Indirect losses or consequential damages
• Service interruptions or website bugs
• Misuse of public information
• Investment decisions based on the site

10. Crypto Loans - Specific Clauses

10.1 Collateral

• You retain ownership of your crypto, CBC securely holds it
• Transfer to secure multi-sig wallet
• Full insurance on collateral

10.2 Margin Call

If the collateral-to-loan ratio falls below 120%, CBC may require additional collateral within 48h. Non-compliance results in liquidation of collateral.

10.3 Volatility

⚠️ Cryptocurrencies are EXTREMELY volatile. CBC offers no protection against loss of value.

11. Duration and Termination

11.1 Duration

The loan contract begins upon signing and ends upon full repayment.

11.2 Withdrawal

Withdrawal period: 14 calendar days from signing. Write to us at: contact@cbresilleyconsulting.ch

11.3 Termination

CBC may terminate if: non-payment for 60+ days, fraud detected, serious violation of terms.

12. Legal Compliance

• Applicable law: Swiss law and applicable European law
• Jurisdiction: Courts at the company's registered office
• GDPR: Full data protection
• AML: Anti-money laundering compliance
• Financial Code: Compliance with credit regulations
